Midsummer Place
These are the terms and conditions for the Midsummer Markets network, found at www.midsummerplace.co.uk/midsummer-markets
The promoter of this network is Midsummer Place managed by property company Midsummer Place Ltd, 35 Ballards Lane, London, United Kingdom, N3 1XW, a company registered in England (“we”, “us” or “our”).
To sign up to the Midsummer Market Network (“Network”) you must submit your online application (see section 7 below). There is no end date for applying, although Midsummer Place Ltd reserves the right to close applications at any time.
If you wish to participate in the Network, you agree to these terms and conditions (“Terms”). By submitting the online application form, all entrants will be deemed to have accepted these Terms, so please read these Terms carefully.
The Network is only open to legal residents of the UK aged 18 and over.
No purchase or payment of any form is required to apply or be part of the Network.
All application instructions for the Network will form part of these Terms. Application instructions can be found at www.midsummerplace.co.uk/midsummer-markets
To apply for the Network, you must submit your application. The first part of the application is a survey monkey form which must be completed in full, details on where to access this survey can be found at www.midsummerplace.co.uk/midsummer-markets.
Applicants will then be contacted by Midsummer Place Ltd.’s marketing team within two working days with feedback on the application. If the application is approved, the applicant will then be given further details on the second stage of the application which will include producing health and safety document for their market set up. Once this stage is approved by Midsummer Place Ltd.’s compliance team, the applicant’s membership to the Network will be complete.
Please note that Midsummer Place Ltd reserves the right to decline any application they do not consider suitable for the centre. Their decision is final.
Once the application to the Network is complete, the applicant will have the ability to book to participate in any suitable markets at Midsummer Place, via the Eventbrite platform. Dates and links for each will be provided by the Midsummer Place Marketing team.
The Eventbrite link will close for new bookings 5 days prior to each market date, or if spaces become full prior to that, whichever is first.
When the Network member books via Eventbrite, they will be issued a booking agreement for the market by Midsummer Place Ltd.
The booking agreement acts as a contract and must be signed and returned in full by the applicant within seven days of booking, to confirm their booking. If the licence is not returned, the booking will be released for other Network members.
Once the booking agreement is signed, the applicant will be liable for the fee. The applicant will be liable for the fee in full unless they cancel a minimum of one calendar month or more before the market date. The fee will be invoiced by Midsummer Place Ltd.
The fee for participating in a market starts from £35.00 (Thirty-Five Pounds) inclusive of VAT per day. The price includes:
Applicants are responsible for ensuring that their market set up is in keeping with their original application in terms of design, product / service display and equipment. Midsummer Place Ltd do not provide any tables or other equipment, unless specifically specified on the event description on the Eventbrite booking form.
Midsummer Place Ltd makes no commitment to what footfall will be in the centre on the day of the market, nor to Midsummer Place Ltd accept responsibility for the applicant’s level of sales during the markets.
As part of the application process, Midsummer Place Ltd will request information from the applicants regarding their website and social media details. The Midsummer Place marketing team and their appointed agencies will share this information so each market can be promoted via the Midsummer Place website, social channels, and PR.
Midsummer Place Ltd will provide a social media toolkit once an applicant is successfully approved to the Network, with ideas for social posts for before and during the markets. There is no obligation to use them, but it offers guidance to those who might like it. As appropriate, bespoke assets and updates to suggested post text might also be issued seasonally or to support certain markets.
The Midsummer Place Marketing team also reserve the right to work with relevant influencers to help promote the markets.
If any of the applicants’ details, contact details, web addresses or social handles change after they originally join the network, it is the applicant’s responsibility to update Midsummer Place with the new details.
Approval to join the Network will be granted based on the applicants brand and products or services. Should the business change at any time after the applicant is approved to join the Network, it is the applicant’s responsibility to notify the Midsummer Place Ltd marketing team, to check and secure approval for ongoing eligibility. Changes to the nature of the business could also result in new health and safety documentation being required.
Approval to the Network is only granted for the period that the applicant’s public liability insurance document is valid for. When the insurance expires, the applicant will need to resubmit their new public liability insurance document and refreshed health and safety documentation for their membership of the network to be renewed. Any member who allows this to expire will be on stop and not be able to book to participate in markets until the new documentation is approved by Midsummer Place Ltd.’s compliance team.
Information you provide to us on the application form will be used to administer your application to the Network and to contact you only for the purposes of the Network and will deleted after 6 months should your application be unsuccessful, unless you have signed up to be contacted by Midsummer Place and its retailers for marketing purposes or wish to be contacted by the centre’s letting representatives. We will not pass on your information to any other third parties other than those specified within these terms, and you can opt-out from direct marketing at any time.
We will keep your personal information secure and will process it in accordance with all applicable data protection legislation. Midsummer Place Limited (company number 08133358) whose address for service of any notice is 35 Ballards Lane, London, United Kingdom, N3 1XW are data controllers for the purposes of European Economic Area data protection law in respect of your data.

We reserve the right at our sole discretion to disqualify any applicant that tampers or attempts to tamper with the application process or the operation of the Network or website; violates the Terms; centre rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Network may be a violation of criminal and civil law, and, should such an attempt be made. We also reserve the right to seek damages from any such person and entrant to the fullest extent permitted by law.
Our failure to enforce any term of the Terms shall not constitute a waiver of that provision. We reserve the right, at our sole discretion, to cancel, terminate, modify or suspend the Network or application process if it is not capable of running as planned, including, but not limited to, infection by computer virus, tampering, unauthorised intervention, fraud, technical failures or any other problems beyond our control. Other than for fraudulent misrepresentation or death or personal injury arising from our negligence, we exclude, to the full extent permitted by law, all liability for any loss, damage, cost and expense you may incur, whether direct or indirect and however caused, in connection with this application process or membership of the Network. We are not responsible for lost, late, misdirected, undelivered, incorrect, or inaccurate application forms whether caused by Internet users or by any of the equipment or programming associated with or utilised in the application process, or by any technical or human error which may occur in the processing of the application forms.
These Terms, the application process and Network are governed by English law and you submit to the exclusive jurisdiction of the courts of England and Wales.
