How to submit your vote:

Head to midsummerplace.co.uk/events/christmas-tree-festival and follow the SurveyMonkey link to cast your vote.

One entry per person. Each entry covers three votes for their three favourite trees. If a voter breaches these terms and makes multiple votes, then Midsummer Place has the right to discount any additional votes. These include votes that are made in the same name or email address multiple times, multiple times meaning more than once.

There is no charge when voting online, however, internet service provider’s fees may apply when you access the internet. Midsummer Place are not responsible for any technical issues with online votes.

Please note you must vote within opening and closing times mentioned below. Votes outside of this period will not be counted.

Please note it is not possible to vote via any method not stated in these terms and conditions.

Opening/closing times

You will be able to vote either in person or online between 9am on Saturday 16th November 2024 and 5pm on Tuesday 24th December 2024. Votes that are cast outside of this period will not be counted.

Voting restrictions

Viewers voting on the website and in person are limited to one vote per person during the voting period. If a person votes multiple times for one tree, Midsummer Place reserve the right in their sole discretion to disqualify any votes made.

Please note you are voting for your favourite three trees in our Christmas Tree Festival. The three companies/ organisations with the most votes will win a share of the prize fund for their chosen charity. By voting for a tree you are not entering to win a prize yourselves, the prize fund is only available to those companies/ organisations that have sponsored a tree. The voter is only voting for a winner, the voter will not win or be entitled to the prize fund or any prize.

Voting results

Once the voting window has ended, the votes will be counted and the winners will be announced in December 2024. The charity donation to the winners nominated charities will be made in January 2025. The donation will be made by Midsummer Place Limited.

In the event of a tie, the trees with the same votes will be randomly selected. The tree chosen from the random generator will take the higher position, whilst the tree(s) that were not selected by the random generator will then be awarded the next position in the list. The only time this will differ, is if there is a tie for third place, then the tree chosen by the random generator will take the third place spot and the tree not selected by the random generator will not be awarded a place. Midsummer Place’s decision will be final.

Contingencies:

The individual companies and organisations are responsible for ensuring their tree is decorated and maintained, Midsummer Place will not take responsibility for their decorations or choice of decorative theme.

General

We reserve the right at our sole discretion to disqualify any entrant that tampers or attempts to tamper with the entry process or the operation of the competition or website; violates the Terms; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the competition may be a violation of criminal and civil law, and, should such an attempt be made. We also reserve the right to seek damages from any such person and entrant to the fullest extent permitted by law.

Our failure to enforce any term of the Terms shall not constitute a waiver of that provision. We reserve the right, at our sole discretion, to cancel, terminate, modify or suspend the competition if it is not capable of running as planned, including, but not limited to, infection by computer virus, tampering, unauthorised intervention, fraud, technical failures or any other problems beyond our control and award the prize from among all eligible votes received prior to cancellation. Other than for fraudulent misrepresentation or death or personal injury arising from our negligence, we exclude, to the full extent permitted by law, all liability for any loss, damage, cost and expense you may incur, whether direct or indirect and however caused, in connection with this competition. We are not responsible for lost, late, misdirected, undelivered, incorrect, or inaccurate entry forms whether caused by Internet users or by any of the equipment or programming associated with or utilised in the competition or by any technical or human error which may occur in the processing of the entry forms.

These Terms and this competition are governed by English law and you submit to the exclusive jurisdiction of the courts of England and Wales.
