Boulevard Unplugged: Terms and Conditions

These are the Terms and Conditions to join the Boulevard Unplugged network found at midsummerplace.co.uk/boulevard-unplugged

  1. To participate in Boulevard Unplugged (performing live on The Bandstand at Midsummer Place Shopping Centre and/or on Horizon Radio), you must submit your online application found at midsummerplace.co.uk/boulevard-unplugged
  2. If you (the “Applicant/ Artist”) wish to participate in Boulevard Unplugged (the “Event”) at Midsummer Place Shopping Centre (the “Venue”) and on Horizon Radio, you agree to these terms and conditions (“Terms”). By submitting your application, all entrants will be deemed to have accepted these Terms, so please read these Terms carefully.
  3. The organisers of this event are Midsummer Place, managed by property company Midsummer Place Ltd, 35 Ballards Lane, London, United Kingdom, N3 1XW, a company registered in England, and Horizon Radio (“we”, “us” or “our”).

Entry

4. The Event is only open to legal residents of the UK, and the Applicant / Artist must be aged 18 or over.

5. To apply for the Event you must submit your online application. There is no end date for applying, although Midsummer Place Ltd reserves the right to close applications at any time. All applications will then be reviewed by a panel of judges. Any Applicant / Artist who do not follow all of the instructions in these Terms, provide the required information, and/or abide by these Terms may have their application rejected. Please note that Midsummer Place Ltd reserves the right to decline any application they do not consider suitable for the centre. Their decision is final.

6. Within two working days of receiving the application, the Venue will contact the Applicant / Artist, by email or telephone. Provided the criteria has been set out in these entry terms, the Applicant / Artist will be invited to book performance slots during the Event. Only pre-approved and pre-booked Applicant / Artist’s can perform at the Venue.

7. Performance slots are subject to availability and at the discretion of the Venue. Performance slot are a maximum of two-hours per day. No more than two Applicant/ Artist's can perform per day.

8. As part of the application process, Applicant / Artist’s will need to submit a representative video file of their performance, to evidence they are wholly suitable for a family audience, with no religious or political bias, to perform at the Venue. If the judges decide this criterion has not been met, the application to perform at the Venue will be declined. In this instance, Horizon Radio will still have the option to contact the Applicant / Artist regarding a radio performance, given there is no explicit language or drug references. If explicit language and/or references are used, the Applicant/ Artist must take responsibility for any consequences, including paying an Ofcom fine should the radio station receive one. 9. Should an approved Applicant / Artist include content in their live performances that is not suitable for a family audience, or has religious or political bias, the Venue reserves the right to terminate the live performance with immediate effect, cancel any future bookings and remove the Applicant / Artist’s approved status for making future bookings.

10. If the Applicant / Artist wishes to discuss potentially contentious content, they can highlight this in their initial application, or in advance of their live performance, by speaking with centre management at the Venue. The decision of the Venue and/or any independent judge (as applicable) is final and binding in all matters relating to this Event, and no correspondence will be entered into on the matter.

11. The Venue will provide the Applicant / Artist performance space and speakers only. No green room, storage facilities, or additional AV / sound equipment will be provided by the Venue. Should additional sound or AV equipment be required, it must be brought to the Venue by the Applicant / Artist and pre-agreed with the Venue. If electrical equipment requires mains power, PAT certificates must be provided by the Applicant / Artist. The Venue can advise on this if required.

12. The Venue cannot not take responsibility for the Applicant / Artist’s personal property or equipment at the Venue.

13. During the Event, the Applicant / Artist will have the opportunity to busk, sell merchandise, or promote their act for commercial hire (as relevant) although details must be agreed in writing, in advance of the performance, with the Venue. No hawking on site is permitted.

14. Noise levels must be managed carefully by the Applicant / Artist. If at any time during a live performance, the volume is disruptive to the Venue’s tenants and visitors, the Applicant / Artist will be asked to reduce to an acceptable level. If the disruption continues, the Venue reserves the right the terminate the current and all future bookings with the Applicant / Artist.

15. Applicant / Artists can film their performances or host live streams on social channels; however they will need to display signage to inform the public that filming is taking place and make sure they remain compliant with GDPR. This must be agreed in writing with the Venue in advance so they can assist with production of posters.

16. Filming and photography may be commissioned by the Venue and Horizon Radio for the purposes of marketing, PR, advertising, reporting and general promotional purposes. All artists taking part in the Event will be required to complete a photography / film waiver prior to their first live performance.

17. As part of the application process, Midsummer Place Ltd will request information from the applicants regarding their website and social media details. The Midsummer Place marketing team and their appointed agencies will share this information so each market can be promoted via the Midsummer Place website, social channels, and PR.

18. During weekdays, individual selected songs from Bandstand Unplugged performances will, where possible, be broadcast live on Horizon Radio and be recorded for future broadcast including on the Local Music Show. There will be an opportunity for some live interviews, but this is not guaranteed to all acts and is at the sole discretion of Horizon Radio. Weekend performances are not guaranteed to get recorded and therefore not broadcast on Horizon Radio.

19. Horizon Radio will be acting as a media partner and providing regular updates on air and on their website on upcoming performances.

20. Not all performances will be suitable for broadcast and this is at the discretion of Horizon Radio. Horizon Radio may choose not to broadcast live performers who appear regularly on the bandstand and have already been featured.

21. Applicant / Artist's will make their bookings via the Midsummer Place marketing team. Dates and times for each performance slot will be provided by the Midsummer Place Marketing team.

22. The Venue will need some further information about the Applicant / Artist and performance for the purposes of health and safety, which the Venue will obtain from the Applicant / Artist at the time of booking. Each Applicant / Artist will need to supply a risk assessment, method statement, public liability insurance and PAT certificates for any electrical equipment (where applicable). The Venue will help advise on these if required.

23. Any information the Applicant / Artist provides on their application form will be used to administer the Event and allow communication between the Event parties only. All information will be deleted after 6 months from the conclusion of the Event, unless the Applicant / Artist has expressly asked to be contacted by the Venue or Horizon Radio for marketing purposes and future events, or the performance agreement has been extended.

24. The Venue may require the Applicant / Artist date of birth to verify that the Applicant / Artist is entitled to apply but will not use it for any other purpose. Neither Horizon Radio or the Venue will pass on the Applicant / Artists information to any other third parties, and the Applicant / Artist can opt-out from direct marketing at any time.

25. Personal information will be securely shared between the Venue and Horizon Radio in accordance with all applicable data protection legislation. Midsummer Place Ltd whose address for service of any notice is 35 Ballards Lane, London, United Kingdom, N3 1XW are data controllers for the purposes of European Economic Area data protection law in respect of your data.

27. The Venue reserve the right, at our sole discretion, to disqualify any Applicant / Artist that tampers, or attempts to tamper with the entry process, or the operation of the Event; violates the Terms; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Event may be a violation of criminal and civil law, and should such an attempt be made. The Venue also reserve the right to seek damages from any such person and Applicant / Artist to the fullest extent permitted by law.

28. The Venue reserve the right, at our sole discretion, to cancel, terminate, modify or suspend the Event, if it is not capable of running as planned, unauthorised intervention, fraud, technical failures or any other problems beyond the Venue's control. Other than for fraudulent misrepresentation or death or personal injury arising from our negligence, we exclude, to the full extent permitted by law, all liability for any loss, damage, cost and expense you may incur, whether direct or indirect and however caused, in connection with this Event.

30. No purchase or payment of any form is required to apply or be part of the Event.
